Migrant and seasonal farmworkers are entitled to receive labor contracts at the start of their job. During the recruitment process, the Agriculture Worker Protection Act protects their right to be provided written information about wages, hours, workers’ compensation, working conditions, and housing.
Migrant Legal Aid helps to protect these rights and stand up against infringements on the worker’s contracts. In case a worker is not given the number of hours per week stated in the contract, Migrant Legal Aid represents this client in order to hold growers accountable in maintaining their labor contract.
Migrant workers heavily rely on the fact that their contracts will be maintained, because they rely so heavily on every hour of work and each paycheck.
Fair Labor Standards Act
Migrant Legal Aid helps to explain and enforce the rights of migrant workers, such as those granted by The Fair Labor Standards Act. This act grants individuals the right to a minimum wage and overtime pay, and it protects the standards of record-keeping and youth employment. These standards apply for all workers, even those who earn their wages by piece rate, as migrant farm workers often do.
Migrant and Seasonal Agriculture Worker Protection Act
Additionally, Migrant Legal Aid helps enforce the Migrant and Seasonal Worker Protection Act. This act requires that families have bathroom facilities while working in the fields, potable drinking water and hand-washing facilities; it also requires that migrant workers be given the terms and conditions of their work in writing.
